Class of Doctors' File A SuitClaiming KFC's Grilled Chicken is often a Health Risk

Immediately after losing its first battle against fast-food dinning establishments, a physicians party went back again to court Wednesday and accused the KFC chain of selling grilled chicken with dangerous amounts of your cancer-causing chemical substance.

In a lawsuit in San Francisco Superior Court, the Physicians Committee for Responsible Medicine accused KFC of violating California's Proposition 65, which requires businesses to warn customers if they're being exposed to substances that cause cancer or birth defects.

The chemical cited in the lawsuit, known as PhIP, is really a byproduct with the grilling process and was added for the state's list of carcinogens in 1994. The physicians group claimed an independent laboratory discovered the substance in every one of 12 grilled chicken samples bought from six East Bay KFC dining places in May.

The suit seeks an order requiring consumer warnings in all KFC dining places in California using the Kentucky Fried Chicken Recipe and penalties to the express of as significantly as $2,500 a day for violations.

The organization, which has 7,000 physician members, built identical arguments last year in a match against other dining places that promote grilled chicken. Burger King decided to warn buyers in the presence of PhIP, but other defendants, led by McDonald's, held their ground and won a ruling from the Los Angeles judge dismissing the case.

The judge explained a federal law that requires labeling of some chicken products prohibits California from imposing stricter standards below Prop. 65. The medical doctors group is appealing.

The lawsuit faces an additional obstacle: The express attorney general's workplace, in response to some complaint in the physicians group, conducted its personal study and concluded in 2006 that PhIP ranges in cooked chicken were too small to require a Prop. 65 warning.

The attorney general's position isn't binding on the courts, but KFC cited the conclusion in its comment on the match.

Firm spokesman Rick Maynard mentioned KFC's "Kentucky Grilled Chicken" product "meets or exceeds all federal and think regulations for meals security." The medical doctors organization, he extra, "promotes a vegetarian agenda."

The group's scientific and policy adviser, Kristie Sullivan, agreed that it promotes a vegetarian eating habits but explained the recent tests of KFC chicken confirmed that it contains a hazardous element.
